NOTICE TO USERS

These Terms of Service ("Terms") are provided for informational purposes only and outline the general policies and expectations for clients utilizing the services of Barrkera, a sole proprietorship operated by the undersigned. By accessing this website or engaging our services, you acknowledge and accept these policies. These Terms do not constitute a binding contract unless otherwise agreed in writing. Specific terms and conditions may be negotiated separately in writing prior to the commencement of services.

AGREEMENT TO TERMS

These Terms of Service constitute a binding agreement between you, whether personally or on behalf of an entity ("you," "your," "client," "customer," or "user"), and Barrkera, a sole proprietorship ("Company," "we," "us," or "our"), concerning your access to and use of our services and website. You agree that by accessing our website or engaging our services, you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THESE TERMS, YOU ARE PROHIBITED FROM USING OR ACCESSING OUR SERVICES.

DESCRIPTION OF SERVICES

Barrkera provides professional dog training services, including but not limited to:

  • Private in-home training sessions

  • Virtual video training consultations

  • Group training classes

  • Obedience training programs

Services are provided on a session-by-session basis with the goal of teaching clients how to train and work with their dogs. Training sessions typically last one hour and occur at frequencies of 1-2 times per week, conducted at the client's home, public spaces, or via virtual meetings.

PAYMENT TERMS AND CONDITIONS

Payment Requirements:

  • Assessment services require payment at the commencement of the session

  • Virtual training sessions require payment at the beginning of the virtual meeting

  • In-person training programs offer three payment options:

    • Full payment at the first session

    • Two-payment plan: Payment at commencement and at the beginning of Phase 3

    • Three-payment plan: Payment at commencement, beginning of Phase 3, and end of Phase 3

Accepted Payment Methods:

  • Non-cash payments (check, gold, silver)

  • Credit card payments via authorized payment processors (Stripe, Shopify)

Late Payment: Failure to remit payment in accordance with the agreed-upon schedule may result in suspension of services.

HEALTH AND SAFETY REQUIREMENTS

Vaccination Requirements: All dogs must provide current proof of rabies and parvovirus vaccinations prior to service commencement.

Health Certification: Clients represent and warrant that their dog has been examined by a licensed veterinarian and is in good health and suitable for training activities.

CANCELLATION AND RESCHEDULING POLICY

Notice Requirements: Cancellations or rescheduling requests must be submitted at least forty-eight (48) hours prior to the scheduled session.

Exceptions: Weather-related cancellations or emergency situations may be accommodated at the Company's discretion, and such accommodations are provided on a case-by-case basis.

ASSUMPTION OF RISK AND RELEASE OF LIABILITY

Acknowledgment of Risk: Client expressly acknowledges and understands that dog training involves inherent risks, including but not limited to dog bites, property damage, bodily injury, and other hazards that may arise from working with animals. Client acknowledges that dogs are unpredictable animals with their own will and drives and that regardless of training, handling, or environmental circumstances, the Company cannot protect against every potential injury, risk, or accident.

Assumption of Risk: Client voluntarily assumes all risks associated with dog training services, including but not limited to risks of bodily injury, property damage, and all other hazards inherent in working with animals. This assumption of risk extends to the client, their family members, guests, and any other persons who may be present during training sessions.

Release of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, CLIENT RELEASES, WAIVES, AND FOREVER DISCHARGES THE COMPANY AND ITS OWNERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, DEMANDS, SUITS, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATING TO ANY LOSS, DAMAGE, OR INJURY THAT MAY BE SUSTAINED BY CLIENT, CLIENT'S DOG, OR ANY OTHER PERSON OR ANIMAL DURING OR AS A RESULT OF TRAINING SERVICES.

LIMITATION OF LIABILITY

Monetary Limitation: The Company's total liability to Client for any and all claims arising out of or relating to these Terms or the provision of services shall not exceed the total amount paid by Client for the services giving rise to the claim.

Exclusion of Consequential Damages: IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, REGARDLESS OF THE THEORY OF LIABILITY.

INDEMNIFICATION

Client agrees to indemnify, defend, and hold harmless the Company from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) Client's use of the services; (b) Client's violation of these Terms; (c) Client's violation of any rights of another; or (d) any actions or omissions of Client or Client's dog during or after training sessions.

CLIENT RESPONSIBILITIES

Dog Ownership: Client represents and warrants that they are the legal owner or authorized guardian of the dog(s) receiving training services.

Compliance with Instructions: Client agrees to follow all training instructions and recommendations provided by the Company and to implement prescribed training techniques outside of formal sessions.

Dog Behavior: Client acknowledges and agrees that they are solely responsible for their dog's actions and behavior at all times, including during training sessions.

Supervision: Client agrees to directly supervise any minors present during training sessions and to ensure compliance with all safety protocols.

MEDIA RELEASE

Client grants the Company the right to photograph, record, and use the likeness of Client and Client's dog for promotional, educational, and marketing purposes, including but not limited to website content, social media, and advertising materials.

DISPUTE RESOLUTION

Informal Resolution: The parties agree to first attempt to resolve any disputes through direct communication between the parties.

Mediation: If informal resolution is unsuccessful, the parties agree to submit the dispute to mediation before a mutually agreed-upon mediator.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Texas.

DISCLAIMERS

No Guarantees: THE COMPANY MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES REGARDING THE EFFECTIVENESS OF TRAINING SERVICES OR THE FUTURE BEHAVIOR OF CLIENT'S DOG. Client acknowledges that the Company has not represented, promised, guaranteed, or warranted that the dog will never bite, will not be dangerous in the future, will not exhibit behavioral problems, or that training results will last for any particular duration.

Insurance Coverage: The Company maintains professional liability insurance through Business Insurers of the Carolinas. However, such insurance does not constitute a warranty or guarantee of services or outcomes.

MODIFICATIONS

The Company reserves the right to modify these Terms at any time by posting updated terms on our website. Continued use of services after such modifications constitutes acceptance of the revised Terms.

SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties and supersede all prior or contemporaneous understandings, representations, or agreements relating to the subject matter hereof.
